FCA-Compliant Crypto Marketing for UK Firms
FCA compliant crypto marketing matters because marketing crypto in the UK is a regulated activity in all but name. Since 8 October 2023, every promotion of qualifying cryptoassets to UK consumers has had to travel through a lawful section 21 route, carry prescribed risk warnings and build in a 24-hour cooling-off period. Most agencies either ignore this or refuse UK work entirely. As a crypto marketing agency active in the UK since 2022, we build campaigns that perform inside those rules rather than around them.
Quick answer: FCA-compliant crypto marketing means every consumer-facing promotion is communicated or approved under section 21 FSMA, carries the FCA's prescribed risk warnings, respects the 24-hour cooling-off period and avoids banned incentives such as refer-a-friend bonuses. Cohort Marketing plans and runs PR, SEO, KOL and community campaigns to those constraints, working alongside your compliance and legal function, we are a marketing agency, not legal counsel.

The 2026 Deadline: Why UK Crypto Marketing Prep Starts Now
The UK's full cryptoasset regime is no longer hypothetical. The Financial Services and Markets Act 2000 (Cryptoassets) Regulations 2026 were made on 4 February 2026, the FCA published its final rules on 30 June 2026, and the authorisation gateway opens on 30 September 2026. The application window closes on 28 February 2027, and the regime goes fully live on 25 October 2027. Every firm applying will be judged partly on how it acquires customers.
That creates a narrow window where marketing and authorisation strategy have to move together. Firms that build a compliant acquisition engine now (approved promotions, clean funnels, documented KOL processes) walk into their FCA application with evidence instead of promises. Firms that keep running grey-area growth tactics into 2027 hand the regulator reasons to refuse them.

Financial Promotions Under Section 21: What Compliant Actually Means
A UK crypto promotion is only lawful if it is communicated by an FCA-authorised person, approved by one, communicated by an MLR-registered cryptoasset business under the bespoke exemption, or covered by a Financial Promotion Order exemption. On top of the route, the FCA requires prescribed risk warnings, a 24-hour cooling-off period for first-time investors with a firm, and personalised risk summaries, and it bans incentives to invest such as refer-a-friend bonuses.
We are not your law firm and we do not give legal advice. What we do is design creative, media plans and influencer briefs that fit the route your compliance team has chosen, keep approval trails for every asset, and flag anything that looks like an inducement before it ships. Your legal counsel signs off the promotion; we make sure there is something worth signing off.
PR, SEO and GEO: The Channels the Rules Barely Touch
The promotions regime bites hardest on direct inducements to invest, which is exactly why earned and organic channels carry UK crypto growth. Genuine editorial coverage, founder commentary on regulation, and data-led stories placed through a crypto PR agency build credibility without triggering the same approval burden as paid consumer promotions, provided they stay factual and are handled with compliance in the loop.
Search behaves the same way. UK users researching "FCA-registered exchange" or "is staking legal in the UK" are high-intent and underserved, because most competitors are afraid to publish. Ranking educational, accurately-caveated content in Google and in AI answers is the cheapest compliant acquisition most UK crypto firms are not doing, and it compounds while your authorisation application is in the queue.

KOL Campaigns in the UK: Possible, With Discipline
Influencer marketing is where UK crypto firms most often break the law without noticing, because a KOL's post promoting your product to UK consumers is a financial promotion regardless of who wrote it. The FCA and ASA have said so explicitly, and unapproved promotion is a criminal offence. That does not make KOL marketing impossible. It makes undisciplined KOL marketing impossible.
Our crypto influencer marketing process was built for this: from 5,000+ vetted KOLs we select creators willing to work from compliance-cleared briefs, lock ad disclosure and risk-warning language into contracts, route scripts through your approval workflow before publication, and archive every deliverable. Where a campaign cannot be made compliant for UK audiences, we geo-shape it toward markets where it can run.
Who Must Act: The Authorisation Wave Is a Positioning Moment
The new regime captures cryptoasset trading platforms, dealing as principal or agent, arranging, custody and safeguarding, arranging qualifying staking, and issuing qualifying stablecoins. Critically, there is no automatic conversion for the firms already registered with the FCA under the Money Laundering Regulations: they must apply for full FSMA authorisation like everyone else. Hundreds of firms will hit the same gateway in the same five-month window.
Authorisation is therefore also a marketing event. The firms that emerge from the gateway with credible, compliant brands will consolidate UK market share the way early MiCA-compliant marketers did in the EU. Preparing the narrative now (regulatory-readiness PR, founder authority, a clean promotions track record) is how you make the licence worth more than the paper it is printed on.

Frequently Asked Questions
What is the FCA authorisation gateway for crypto firms?
It is the application window for the UK's new cryptoasset regulated activities regime under FSMA. The gateway opens on 30 September 2026 and closes on 28 February 2027, with the full regime commencing on 25 October 2027. Firms doing regulated cryptoasset activities in or to the UK must apply for FCA authorisation during this window to keep operating.
Can we still run crypto KOL campaigns in the UK?
Yes, but every influencer post promoting a qualifying cryptoasset to UK consumers counts as a financial promotion, so it must go through a lawful section 21 route with the required risk warnings. In practice that means compliance-cleared briefs, contractual disclosure language, pre-publication approval and archived deliverables. We run UK KOL campaigns exactly that way, or geo-shape them to other markets.
What are the FCA rules for crypto financial promotions?
Since 8 October 2023, promotions of qualifying cryptoassets to UK consumers must be communicated or approved by an FCA-authorised person, made by an MLR-registered firm under the bespoke exemption, or fall within an exemption. They must carry prescribed risk warnings, give first-time customers a 24-hour cooling-off period, and cannot include incentives to invest such as refer-a-friend bonuses.
What happens if we promote crypto in the UK without approval?
Communicating an unlawful cryptoasset promotion breaches section 21 of the Financial Services and Markets Act, which is a criminal offence punishable by up to two years' imprisonment, an unlimited fine, or both. The FCA also issues warning alerts, requests takedowns and can block firms' future authorisation. This applies to overseas firms marketing to UK consumers, not just UK companies.
Is Cohort Marketing a law firm or compliance consultancy?
No. Cohort Marketing is a crypto marketing agency operating since 2022, and nothing we produce is legal advice. We design and run PR, SEO, KOL and community campaigns built to fit the promotion route your legal and compliance advisers have chosen, keep approval trails for every asset, and coordinate with your counsel so campaigns ship compliant and on schedule.
